Drunk driving accidents may prompt wrongful death civil suits

The decision to drink or take other intoxicating substances does not only affect a driver’s future; it may also lead to another family losing a loved one. In the event that a crash can be attributed to drunk driving, the victims’ families may have recourse to seek justice through a wrongful death civil lawsuit. Recently, Tennessee officials arrested and charged a man with killing a woman while he was driving impaired

The crash was reported around 9 p.m. on a recent Friday evening. According to officials, a 39-year-old man was driving his full-size pickup along a local road near a bridge. For reasons that are yet unclear, the driver’s truck collided with the rear of the vehicle traveling ahead of him. The 49-year-old female then lost control of her car.

Her vehicle collided with a metal structure and a concrete retaining wall before winding up in the opposing travel lanes. It was then struck by a third vehicle. Though she was transported from the scene for emergency care, she was later pronounced deceased from her injuries. The pickup truck also traveled across opposing traffic lanes before colliding with fencing. Neither he or any passengers in the third car suffered injuries in the incident.

Tennessee police arrested and charged the driver after a blood sample obtained by a court order indicated that he was impaired at the time of the crash. He is facing charges that include impaired vehicular homicide and driving while his license is suspended. It may come as little comfort for the victim’s family that the driver deemed responsible is facing criminal charges. Along with the emotional pain of losing their loved one, they must also bear the financial burdens that these unexpected and avoidable crashes cause. Families who find themselves in these circumstances may consider pursuing recompense for their documented losses by pursuing a wrongful death claim through the Tennessee civil justice system.
