Personal Injury FAQ
At Boren & Boyd, PLC, in Jackson, Tennessee, we provide general information to potential clients before delving further into their specific situations. The following are just some of the most commonly asked questions we receive regarding personal injury claims, especially those involving motor vehicle accidents.
Do I have a case if I wasn’t wearing a seat belt when an accident occurred?.
If the other driver was to blame for the collision, you may have a claim, and the fact that you were not wearing a seat belt does not change that. While it may be considered contributory negligence that could result in a deduction from your claim, that is not always the case.
I understand my immediate medical bills will be paid, but what about future long-term effects?.
We will pursue every avenue of injury to try and get you compensated, and if your injuries are a result of an automobile accident that was not your fault, we will work with the other driver’s insurance company.
What if I can’t work or I lose my job because of the injury?
Your lawyer will recommend that you contact your creditors and ask them to suspend your payments until you have returned to work. Another avenue is to see if you have credit disability insurance, which will make your payments for you during the period in which you are disabled. At the request of your creditors, your attorney can verify the accident.
Are there other day-to-day quality-of-life issues for which I can be compensated?.
Yes. We will review your lifestyle, living quarters and need for assistance in daily tasks like shopping, house cleaning and trips to the doctor to ensure those needs are met as well.
What work is done by an attorney prior to settlement negotiation and litigation?.
Your attorney will obtain witness statements, photographs and police and/or hospital official reports to verify how the accident occurred and who was at fault, especially in the case of a distracted driver. Once your physical condition has stabilized, your lawyer will put together medical reports, medical records and bills, employment reports and any other documents necessary to try and prove your damages.
Do I have to accept a settlement offer presented by the insurance company?.
When a settlement offer is received, it will be sent to you for review, and your attorney will discuss possible actions you can take. If a fair settlement is unable to be obtained, we will file a lawsuit or demand arbitration.
