Families of victims may consider merits of wrongful death claims

Losing a loved one is never an easy experience. Unfortunately, Tennessee residents are faced with this tragic situation whenever a fatal crash takes the life of an innocent victim. Recently, one man shared his frustration over the senseless loss of his brother in a hit-and-run crash. These deaths often leave families to bear the financial burdens of an unexpected death. It may be possible to recoup some of these losses through a wrongful death civil suit.

According to Tennessee officials, a man was riding a bicycle home from work at an eatery, on a recent weeknight. His brother, who worked at the same restaurant, reported getting off work and spotting his brother’s body lying motionless in the street. As he rushed to provide aid, he realized that there was little that could be done to save his brother’s life.

Purportedly, a motorist called in to report that he thought he had struck a deer as he traveled along the road that evening. He did not stop to confirm what his vehicle struck, nor did he call for any medical assistance. The brother of the victim stated that his brother may have survived if the driver had stopped at the scene of the collision and called authorities.

Police described the motorist as a person of interest and later placed him under arrest for charges of vehicular homicide. He has been released and will face a court date early next year. The victim’s brother feels that his brother is being denied justice in light of the motorist’s release from custody. In these tragic circumstances, surviving families often struggle to bear monetary burdens as well as their emotional pain. If there is evidence of negligence on the part of another party, families may consider the merits of filing a wrongful death claim in an effort to seek financial relief.
